VacaConnect.com is a Website (“Site”) offered to Vacation Rental Owners and Property Managers (“owners”, “managers”, “listers”) and travelers/renters wishing to search vacation rental properties and inquire and potentially rent a vacation home directly from the vacation homeowner. Use of this Site constitutes your agreement to all of the terms and conditions set forth herein (“Terms of Use”). Please read through the Terms carefully as these terms constitute a legally binding agreement between you and VacaConnect.com (“VacaConnect.com”, “VacaConnect”, “us”, “our” or “we”).

PLEASE BE INFORMED THAT WE ARE NOT A PARTY TO ANY RENTAL TRANSACTION. VacaConnect.com does not own nor can we contract any vacation rental property listed on this Site. Instead, the Site is a venue that allows members (“owners”, “managers”, “listers”) to offer furnished vacation rental listings for rent to potential renters. VacaConnect is not involved in the actual transaction between the Listers and Renters, although we may provide tools to our members, such as direct booking that allows the Renter to enter into a transaction to rent a specific vacation rental property directly from the Lister. As a result, VacaConnect has no control over the legality, quality or safety of the vacation rental properties advertised, the accuracy or truth of the listings, the ability of the Lister to rent the specific vacation rental property or the ability of the Renter/Renters to pay for the rental. VacaConnect cannot ensure that an actual transaction between the Lister and Renter will be completed. Renters will complete transactions and VacaConnect does not make any representations as to the quality, availability, suitability, pricing or location of any specific vacation rental by owner listed. You must not describe your properties in an unlawful or misleading manner and VacaConnect.com may change or remove any description that it considers unlawful or misleading. You must immediately notify VacaConnect of any unauthorized uses of your account or any other breaches of security.

VacaConnect reserves the right to modify its Terms of Use any time without notice. After changes to the Terms of Use have been posted thereon, accessing this Site will determine that you have consented to all changes.

This Site and any associated software, content, files, data, materials (collectively “Associated Materials”) provided by VacaConnect are protected by U.S. and International Copywright and Trademark laws. The content of this Site (i.e. files, photos, text, maps, etc.) are for your personal use only. You are required to abide by Copywright and Trademark rights and any additional Copywright notices related to the content of this Site. Copying, modifying, storing, transmitting, distributing, adapting, reproducing, decompiling, reverse engineering or disassembling any part of this Site is strictly prohibited. Additionally, displaying this Site as a part of or within another Site or Webpage or redistributing any content of this Site or its Associated Materials to any third party for financial gain is strictly prohibited.

VacaConnect.com does not charge travelers/renters any fee to access this Site and research available vacation rental properties, although we do charge a fee to members (“owners”, “managers”, “listers”) to advertise their specific vacation rental property/properties. VacaConnect allows Listers a limited, non-exclusive license to advertise vacation rental properties and grants Renters the right to search and inquire about specific vacation rental properties directly with Owners and/or Managers. Any other use of this Site is expressly prohibited. By submitting information, you grant VacaConnect.com a nonexclusive, royalty-free, perpetual, irrevocable, and full license to reproduce, use, modify, publish, adapt, translate, distribute, and display such content throughout the world in any media. When using VacaConnect.com to send a destination inquiry to a VacaConnect member (“owner”, “manager”, “lister”), you agree to allow VacaConnect to add your email address to our database of travelers. You may opt out from receiving emails from VacaConnect.com at anytime.

Unless otherwise provided within these Terms, you may not do any of the following without VacaConnect’s prior written consent:

• Copying, modifying, storing, transmitting, distributing, adapting, reproducing, decompiling, reverse engineering or disassembling any part of this Site.
• Frame or utilize framing techniques to enclose any Logo, Trademark or other proprietary information (including images, text, page layout) of VacaConnect.com without written permission from VacaConnect.com.
• Use any meta tags or any other "hidden text" utilizing VacaConnect’s name or Trademarks without written permission from VacaConnect.com.
• Use any VacaConnect.com logo or other proprietary graphic or Trademark as part of the link without written permission from VacaConnect.com.
• Reverse engineer any part of VacaConnect.com’s Web Site.
• You do not acquire any ownership rights to any content in the Site. Any unauthorized use terminates the license granted by VacaConnect.com.
• Use any automatic device, or manual process to copy, monitor, or keep a database copy of the content or any portion of the VacaConnect’s Web Site.
• Use the Site for any other other reasons than to advertise vacation rentals, search vacation rentals or post reviews of vacation rental properties.
• Use the "Email This Item to a Friend" service or other email services that we may offer to send spam or otherwise send content that would violate these Terms.
• Post or transmit any obscene, illegal, threatening, or defamatory content and/or any content that invades the privacy or infringe the intellectual property of a third party.
• Publish any content that may contain software viruses, mass mailings, chain letters, or any form of "spam.
• Use of false e-mail address, impersonation of any person or entity, or otherwise misleading as to the origin of the information.
• All of the above applies to our Directory, Blogs & Review services. Any opinion, comment or information made in it by third parties, is not the opinion, comment or information of VacaConnect.com and VacaConnect.com cannot be held responsible for it.

This Site may contain links to Websites operated by parties other than VacaConnect. Such links are provided for your reference only. We do not have the ability to review all of the material, including computer software, made available through the Websites and Webpages to which VacaConnect.com links, and that link to VacaConnect.com. The linked sites are not under the control of VacaConnect and VacaConnect is not responsible for their contents or their use. In the event that VacaConnect links to a non-VacaConnect Website or Webpage, this does not represent or imply that we endorse such a Website or Webpage. You are responsible for taking necessary precautions to protect your computer systems from viruses, worms and other harmful or destructive content. VacaConnect disclaims any responsibility for any harm resulting from your use of non-VacaConnect Websites and Webpages.

The policies of each Lister is up to the individual lister and are in no way under the control of VacaConnect.com. Each Lister will have individual policies governing deposits, rates, availability, payment schedules, check-in and check-out times, rules of property, etc. In most instances your reservation is not confirmed until all payments have been received by the Lister. You should assume this is the situation unless the Lister informs you of another confirmation policy.

When you use VacaConnect.com to send an inquiry to a vacation homeowner/manager/lister, you agree to allow VacaConnect to add your e-mail address to our database of users. You will receive promotional emails and newsletter from VacaConnect and may opt out of these emails at anytime by sending an email to unsubscribe@vacaconnect.com. Please see our Privacy Policy for more information regarding our information safeguards.

If you believe that your work has fallen victim to copyright infringement, or your intellectual property rights have been otherwise violated, please notify us at support@vacaconnect.com

Our relationship is that of independent contractors, and no agency, partnership, joint venture, employee-employer or franchiser-franchisee relations is intended or created by these Terms or your use of this Site.

Except as otherwise stated, in no event will VacaConnect, its suppliers or its licensors be liable to you or any other party for any direct, indirect, consequential, special, punitive or exemplary damages or losses, regardless of the basis or nature of the claim, resulting from any use of the Website, or the contents thereof or of any hyperlinked Website including any loss of profits, loss of data or otherwise, even if VacaConnect has been advised of the possibility of damage or loss. In no event, will the aggregate liability for any and all claims against VacaConnect, its suppliers and/or licensors arising from or relating to these Terms of Use or this Site, or the contents thereof of any hyperlinked Website exceed the amounts paid by you to VacaConnect during the twelve month period prior to the date the claim was originally made.

You represent and warrant the your use of this Site will be in accordance with VacaConnect’s Privacy Policy, Terms of Use, any applicable laws and regulations (including any local laws or regulations in your country, state, city of residence), regarding online conduct and acceptable content. Additionally, you must be in accordance with any applicable laws regarding the transmission of technical data exported from the country in which you reside. VacaConnect disclaims any express or implied warranties, including non-infringement, merchantability and fitness for a particular purpose. VacaConnect makes no warranties or representations as to the completeness or accuracy of this Site, its Associated Materials or the information, materials and functions made accessible by or accessed through this site and the Associated Materials.

You agree to indemnify, defend and hold harmless VacaConnect, its officers, contractors, directors, shareholders, employees, licensors, agents, representatives, partners and owners from and against any and all claims and expenses, including without limitation attorney’s fees, accounting fees, expert witness fees, penalties and interest arising out of your use of this Site or Associated Materials, including but not limited to your violation of any representation or warranty contained in these Terms of Use. VacaConnect has the right at its own expense to assume the exclusive defense and control of any matter subject to indemnification by you and no event shall be settled without the written consent of VacaConnect.

Whether you’re registered, contribute content or are just browsing, you must agree to these Terms of Use. Reviews and posts that are not in compliance with these guidelines are subject to removal.

VacaConnect takes no responsibility and assumes no liability for any Content posted, stored or uploaded by you or any third party, or for any loss or damage thereto. Traveler reviews, forum postings and vacation homeowner responses are the sole opinions of the travelers and vacation homeowners and VacaConnect does not investigate nor guarantee the accuracy of reviews, responses or postings. VacaConnect is not liable for any statements, representations or content provided by its users in any public forum. VacaConnect does not alter, screen, edit or monitor any of the content posted to or distributed through the Site’s public forums. VacaConnect does reserves the right, and has absolute discretion to remove without notice any content posted or stored on the Site at any time and for any reason.
VacaConnect may contain discussion forums, bulletin boards, review services or other forums in which travelers and vacation homeowners may post reviews of vacation rental experiences or other content, messages, materials or other items on the Site. You are solely responsible for your use of such areas on this Site and use them at your own risk. By using the discussion forums, bulletin boards or review services, you expressly agree not to post, transmit, upload to, distribute, store, create or otherwise publish through the Site any of the following:

• Any message, data, information, text, sound, photos, graphics, code or other material that is unlawful, libelous, defamatory, derogatory, obscene, pornographic, indecent, lewd, harassing, threatening, invasive of privacy or publicity rights, abusive, fraudulent or otherwise objectionable.
• Any offensive, humiliating or intimidating comments based on a person’s race, color, ethnicity, nationality, sex or gender, physical characteristics, appearance or mannerisms, religion, political opinion, socio-economic status, age, physical or mental disability or sexual orientation.
• Personal or business contact information of any third party including but not limited to email addresses, Websites, physical addresses, phone numbers, last names, company names.
• Any content made under another person’s name or impersonating another person, any commercial advertising or any solicitation of market research from community members.
• Defamatory or libelous content or references to litigation of law enforcement.
• Content containing any HTML tags or links or references any other vacation rental Websites.
• Content that may infringe any patent, trademark, trade secret, copyright or other intellectual or proprietary right of any party.
• Viruses, corrupted data or other harmful, disruptive or destructive files.
• Content that, in the sole judgment of VacaConnect, is objectionable or which restricts or inhibits any other person from using or enjoying the online community of the Site, or which may expose VacaConnect or its users to any harm or liability of any type.

In order to review a vacation rental property or respond to a review, the traveler and/or vacation homeowner must meet the following guidelines:

• Renter must be able to provide proof of stay in the particular vacation rental property reviewed.
• Renter must provide a valid email address in order for VacaConnect to confirm the validity of the address. Reviews submitted from false email accounts will not be posted.
• Reviewer must be at least eighteen years of age.
• The renter must have arrived at the vacation rental property on the scheduled date of arrival stated in the rental agreement.
• Only one member of the rental party may submit a review of the property.
• A renter can review one particular property one time only, even if the renter has booked the same property numerous times.
• Vacation homeowners may not submit reviews of their own property or allow any acquaintances to do so that have not stayed in the rental property. The review must be from a valid renter.

If you think a posting or review is infringing these Terms of Use, other copyright, trademark, defamation laws, or anyone’s legal rights, please contact us immediately at support@vacaconnect.com. We will investigate all complaints and take any necessary action we deem necessary, including removing content and/or suspending the accused user. Removal of postings and reviews is at VacaConnect’s discretion, except if the content is illegal.

Any use of the online communities (including but not limited to discussion forums, bulletin boards and/or reviews) or other portions of the Site in violation of the foregoing violates these Site Terms and may result in, among other things, termination or suspension of your rights to use the Site. In order to cooperate with legitimate governmental requests, to protect VacaConnect’s customers and systems, or to ensure the integrity and operation of VacaConnect, VacaConnect may access and disclose any information it considers necessary or appropriate, including, without limitation, user profile information usage history, and posted Content.

All sales are final.
